Friends and Family Exhibition - Terms & Conditions 

By submitting Work to this exhibition the Artist agrees to the following terms:

The Artist appoints the Gallery (Daine Singer Gallery Pty Ltd) as an exclusive agent for the exhibition, promotion and sale of the exhibited Work for the period 1 November — 20 December 2019. 


The Artist may submit one work only, with the maximum dimensions of 1 x 1 m for 2D artwork, or 50 x 50 x 50 cm for sculptures.

All 2D works must be delivered ready to hang, for example framed works must have D-rings or picture wire on the reverse.

The Work must be clearly labeled with the Artist’s name (for example on packaging and on the reverse of framed artworks).

The Gallery has the right to refuse display of Work.


The Artist is responsible for transport of the Work to and from the Gallery. Should the Artist want the Work to be covered by transit insurance then the Artist must arrange and pay for this transit insurance. 

The Work must be delivered to the Gallery from: 
12 - 5pm Wednesday 6 November - Saturday 9 November
Works not delivered by this time will not be exhibited.

Unsold Work must be collected from the Gallery in person or by courier, from:
12 - 5pm Sunday 15 December - Monday 16 December

The Gallery will arrange delivery of sold works directly with the buyer.

If you are posting work from overseas please let us know so we can confirm receipt of the work. Please note that Australian customs may charge you taxes and duties on the declared value of posted items, the Gallery accepts no responsibility for import duties and taxes.

Price and Commission

The Gallery will offer the Work for sale at the Retail Price that is determined by the Artist on the application form.

If the Artist is not registered for GST then the Gallery’s commission is 45% plus GST (ie. 49.5%) of the Retail Price of each Work sold. 

If the Artist is registered for GST then the Gallery’s commission is 45% including GST of the Retail Price of each Work sold. 

The Gallery will pay the Artist by EFT the price paid for each sold Work less its commission within 10 days of receiving payment from the buyer. 

Copyright & Title

The Artist retains all rights of ownership of each Work until the Retail Price is paid in full, at which time title passes directly to the buyer.

Copyright in each Work is owned by and remains with the Artist.

The Artist gives the Gallery a perpetual limited licence to reproduce, communicate, and allow others to reproduce and communicate the Works for the following purposes:

(i) publicity for the Gallery, exhibition and Artist’s Works including on websites and social media;
(ii) critical review;
(iii) a catalogue of an exhibition at the Gallery; and
(iv) non-commercial and non-lending archive and reference.

The Gallery may use the Artist’s name, likeness and biography in connection with the exhibition and sale of the Work at the Gallery and in promotion of the Gallery.

The Artist indemnifies the Gallery against any claims of copyright infringement or defamation arising from the Artist’s Work.


While all reasonable care will be taken of the Work, the Gallery is not liable for any loss, damage, theft or destruction of the Work for the period of time that the Work is in the Gallery’s care, custody or control. The Artist is responsible for insuring each individual Work at his or her discretion.
